1. Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of the website located at [www.exitstrategygames.com] (the “Site”) and any escape room or live game experiences, bookings, or related services offered by Exit Strategy Games (“Company,” “we,” “us,” or “our”) (collectively, the “Services”). By accessing the Site or booking our Services, you agree to be bound by these Terms. If you do not agree, do not use the Site or Services.

2. Eligibility

You must be at least 18 years old, or have parental/guardian consent, to book our Services. Participants under 18 must be accompanied by a supervising adult unless otherwise stated at time of booking.

3. Bookings and Payment

  • All bookings made through the Site are subject to availability and confirmation.
  • Full or partial payment may be required at the time of booking.
  • Prices are listed in [USD] and are subject to change without notice; confirmed bookings will honor the price paid at time of purchase.
  • You are responsible for providing accurate booking information (date, time, party size, contact details).

4. Cancellations, Rescheduling, Refunds, and Misc Terms

  • NO REFUNDS will be provided for any reason including but not limited to cancellation, traffic, no-show, illness, emergency surgery, breaking a nail, stubbing a toe, or any other catastrophic event.

  • NO PARTIAL REFUNDS will be provided for any reason including but not limited to the cancelation, no-show, or illness of one or more players from your group. Book your game for the minimum number of guaranteed players and you can add and pay for additional players at the door.

  • Tickets(s) for purchase are non-refundable, refunds will not be issued for any reason.
  • Book for the minimum number of players guaranteed to play and will add any additional players at the door and pay for them at that time. I understand there is a slight glitch in the system that may make it “appear” as if a refund is due (“Amount Due:”) if I cancel online or if I change the booking online to less players than I originally booked for. I understand this WILL NOT BE REFUNDED and that I will not be owed a refund for any reason.
  • ALL players must sign a liability waiver in order to play the game. Players refusing to sign a liability waiver will not be permitted to play the game and NO refund(s) will be issued. All players under the age of 18 must have a parent or guardian sign a waiver for them.
  • ALL players must arrive 15 minutes before their scheduled start time. Late arrivals will have time deducted from their game and NO REFUND will be issued.
  • Any player that is inebriated/intoxicated/drunk will not be allowed to play the game and no refunds will be issued.
  • You may change the game, date, and time of my booking online at least two (2) days in advance of my scheduled game time. All cancellations or no shows within two (2) days of my booking will be forfeited, no reschedules will be allowed. No refunds will be issued due to any changes made to my booking.

  • All players over 4 years of age must have a purchased ticket to enter the room. This includes but is not limited to adults or guardians wishing to supervise.

5. Rules of Participation

By participating in our Services, you agree to:

  • Follow all instructions given by staff/game masters
  • Not force open locked doors, panels, or props
  • Not remove or damage any props, set pieces, or equipment
  • Not bring outside food, drink, alcohol, weapons, or illegal substances into the venue
  • Behave respectfully toward staff and other participants
  • Disclose any relevant medical conditions, mobility limitations, or claustrophobia concerns prior to participation

We reserve the right to remove any participant from the premises, without refund, for behavior that is unsafe, disruptive, or violates these Terms.

6. Assumption of Risk and Release of Liability

Participation in escape room and live game experiences involves inherent risks, including but not limited to physical exertion, confined spaces, low lighting, strobe or sound effects, and interaction with props and puzzles. By participating, you acknowledge and agree that:

  • You participate voluntarily and at your own risk.
  • The Company, its owners, employees, and agents are not liable for any injury, loss, or damage arising from participation, except to the extent caused by our gross negligence or willful misconduct.
  • You are responsible for disclosing any physical or medical condition that could affect your ability to safely participate.
  • You may be asked to sign a separate liability waiver prior to participation; participation is conditioned on execution of that waiver.

Nothing in these Terms limits liability where such limitation is prohibited by law.

7. Photography, Video, and Publicity

We may photograph or record participants during Services for security and quality purposes. By participating, you grant us permission to use such photos/recordings for marketing and promotional purposes, unless you notify us in writing that you opt out prior to your visit.

8. Intellectual Property

All content on the Site, including text, graphics, logos, game designs, puzzles, and trademarks, is the property of Exit Strategy Games or its licensors and is protected by copyright and trademark law. You may not copy, reproduce, distribute, or create derivative works from our content without prior written consent.

9. User Conduct on the Site

You agree not to:

  • Use the Site for any unlawful purpose
  • Attempt to gain unauthorized access to the Site or its systems
  • Interfere with the proper functioning of the Site
  • Submit false or misleading information when booking

10. Third-Party Services

Our Site may integrate with third-party services (e.g., payment processors, booking platforms, review sites). We are not responsible for the practices, content, or availability of third-party services.

11. Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, EXIT STRATEGY GAMES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICES GIVING RISE TO THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless Exit Strategy Games, its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or your participation in our Services.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of [State], without regard to conflict-of-law principles. Any disputes arising from these Terms or the Services shall be resolved in the state or federal courts located in [County, State], and you consent to the jurisdiction of those courts.
